NMa ensures that competition in the Netherlands is fair. It enforces the Competition Act by detecting cartels between undertakings which, for instance, enter into price agreements and by dealing with undertakings which abuse a dominant position. If undertakings wish to merge, they have to notify NMa of their intention to do so. NMa checks whether the merger does not result in an undertaking with a position which is too strong on the market (a dominant position), provided the turnover threshold has been exceeded. Mergers of undertakings which do not exceed the turnover threshold are permitted without notification.

NMa also plays a role in the television/internet/telephony sector. Companies like KPN, Casema and Essent are undertakings. The Competition Act applies to these undertakings. NMa critically monitors the actions of the abovementioned undertakings with a dominant position on certain markets. They may not abuse their dominant position. Examples of the abuse of a dominant position are the use of unfair conditions or the refusal to supply services. If a cable operator disconnects you from other services than those for which you have entered into a contract, this may therefore constitute abuse.
